案例2007年5月,A企业以出让方式取得一宗国有建设用地使用权,但不久该企业就因经营不善破产倒闭,进入破产清算程序。为偿还债务,该宗地被法院查封拍卖,甲公司以1900万元竞得。在办理土地使用权转让手续时,甲公司反悔,决定放弃该宗地。2013年10月,法院再次拍卖该宗地,乙公司以900万元竞得。法院按照事前的约定,要求甲公司补交两次拍卖价款差价1000万元。甲公司不服,认为A企业取得该宗地后6年没有开发,当地政府应当无偿收回该宗地,因此法院没有权利拍卖。
