2006年9月,北京市第一中级人民法院在针对《清华早读》图书和音像制品的商标侵权案件中认定清华大学在第41类教育服务上注册的“清华”商标为驰名商标。事隔一月,国家工商行政管理总局商标局(简称商标局)在“清华智慧”商标异议案件中再次认定“清华”商标为驰名商标。[1]我国公立高校第一个驰名商标自此诞生。一石激起千层浪,由此引发讨论中不乏质疑:清华大学作为向社会公众提供公共教育服务的非营利机构,其申请注册的“清华”商标被认定为驰名商标是否合适?清华大学驰名的是高校名称,还是其商标?
In September 2006, Beijing No. 1 Intermediate People’s Court found Tsinghua University’s Tsinghua trademark registered as a Type 41 education service in a trademark infringement case against “Tsinghua Early Learning” books and audio-visual products as a well-known trademark. In January, the Trademark Office of the State Administration for Industry and Commerce (the “Trademark Office”) once again affirmed “Tsinghua” trademark as a well-known trademark in the “Qinghua Wisdom” trademark opposition case. [1] The first well-known trademark of public universities in our country was born. As a non-profit organization that provides public education services to the public, Tsinghua University is not suitable for applying for registration of “Tsinghua” trademark as a well-known trademark.
