行政问责制度从2003年非典事件正式进入公共视野,经过几年的发展,尤其是今年九月以来在连续发生的重大灾难事故后频繁使用,使人们看到了其制度化和常态化的趋势。目前这项制度仍不够完善,主要表现在:现有规定过于分散、内容太少且效力层级太低;问责主体过于单一;问责事由有待具体化、明确化;程序规定欠缺;党的规定与国家的法律法规没有划清界限等方面。我国行政问责制度的完善,还应该从加强全国统一性立法、完善程序性规定等方面入手,同时,信息公开和公众参与制度的完善也为行政问责制度的发展提供了良好的契机。
The system of administrative accountability formally entered the public field of vision from the SARS incident in 2003. After several years of development, especially since September this year, it has been frequently used after a series of major catastrophic accidents so that people see the trend of institutionalization and normalization. At present, this system is still not perfect. The main features are as follows: the existing provisions are too scattered, the content is too low and the effective level is too low; the subject of accountability is too single; accountability matters need to be specific and clear; procedural rules are lacking; And the national laws and regulations did not draw the line and so on. At the same time, the improvement of the system of information disclosure and public participation also provides a good opportunity for the development of the system of administrative accountability.
