民间借贷在中国已经有了几千年的传统,并不是一个新颖的词汇,但是在近几年的新闻报道或是案件审理中却是十分敏感的话题。其中的原因不乏经济体制改革发展到现在的阶段所带来的尴尬,但更多的是金融机构融资渠道的单一,一些微小企业在发展的过程中势必会遇到资金周转不灵或是扩大生产资金不够的状况,在无法从银行中获得帮助之后,就会转向民间的资本市场,民间借贷应运而生。近些年来,在我国南方以江、浙一带尤为突出,北方则是鄂尔多斯地区闻名。由于在一些民间的借贷案件中资金流转的基数较大,所以在一些地区容易将民间借贷与非法集资等扰乱市场经营秩序的行为混淆,本篇文章即是针对这一现状加以讨论。
Private lending has existed in China for thousands of years and is not a novel term, but it has become a very sensitive topic in recent years when it comes to news reports or case trials. There are many reasons for the embarrassment brought by the reform and development of the economic system to the present stage, but more is the single financing channel of financial institutions. Some small and medium-sized enterprises are bound to encounter the problem of cash flow or production expansion in the process of development When the funds are not enough, they can turn to private capital markets after they can not get help from the banks. Private lending comes into being. In recent years, southern China is particularly prominent in the areas of Jiangsu and Zhejiang, while the north is famous for Ordos. Because of the large base of capital flows in some private lending cases, it is easy to confuse private lending with illegal fund-raising in some areas to disturb the order of market operations. This article is to discuss this status quo.
