从法理学角度讲，正义是法律制度所要实现的最高理想和目标，也是人们用来评价和判断一种法律制度具有正当根据的价值标准。由此可见，正义是法的基本价值，也是最高价值。法引导社会正义，社会正义促进法走向文明。法学研究与法律实践是为了维护公正和正义的事业，因此，法理学应把正义作为其永恒的主题：立法应充分体现社会正义的要求，司法应切实保障社会正义的实现。
From the perspective of jurisprudence, justice is the supreme ideal and goal to be achieved by the legal system, and it is also the justified basis for people to evaluate and judge a legal system. From this it can be seen that justice is the basic value of law and the highest value. Law to guide social justice, social justice to promote law toward civilization. Jurisprudence should regard justice as its eternal theme: legislation should fully reflect the requirements of social justice, and judiciary should effectively protect the realization of social justice. Law research and legal practice are to safeguard the fair and just cause.
