实体真实与正当程序、控制犯罪与保障人权是各国刑事程序所追求的价值目标,也是贯穿于刑事程序始终的时常发生利益冲突的矛盾方面。不得要求任何人自证其罪原则及由此产生的沉默权,则是一国刑事程序在上述相冲突的利益选择上的价值倾向的集中表现之一。因此,本文试对沉默权作一探讨,以期有助于进一步理解该问题。
Substantial and due process of entity, crime control and protection of human rights are the values pursued by criminal proceedings in all countries. They are also contradictory aspects of conflicts of interest that occur throughout criminal procedures. One can not demand that anyone’s principle of self-incrimination and the resulting right of silence be one of the concentrated manifestations of the value tendency of criminal proceedings in a country over the conflicting interests mentioned above. Therefore, this article attempts to discuss the right to silence, with a view to helping to further understand the issue.
