根据我国《物权法》的规定,善意取得制度适用的客体包括动产、不动产和其他物权。然而,由于法条规定过于笼统,加上该制度本身的涉及物权变动、无权处分、占用保护与抗辩等诸多民法理论问题,造成具体法律适用顾此失彼。本文尝试以不动产登记为问题分析视角,从两个层面分别对不动产善意取得适用范围作一些合理限制和适当延伸,为该制度的具体适用提供一些客观参照,以期对司法实践有所裨益。
According to China’s “Property Law”, the object of goodwill acquisition system includes movable property, real property and other real property. However, because the provisions of the law are too general, and the system itself involves many changes in the real right, the right to dispose of, occupy the protection and defense and many other civil law theory, resulting in the application of specific laws to defeat one another. This article attempts to register the real estate as a perspective of problem analysis. From two aspects, it makes some reasonable limits and appropriate extensions to the applicable scope of bona fide property respectively, providing some objective references for the specific application of the system with a view to the benefit of judicial practice.
