一直以来,中国市场上的抄袭、盗版、模仿之风盛行,由最初的盗版电影光盘、到后来的山寨手机、山寨服装、乃至于山寨明星脸等等。国外的企业虽然看中了中国巨大的市场潜力,但也一直因其知识产权在中国不能得到很好的保护而踌躇不前,不敢将中国作为其最新科技、最新产品的投放市场。甚至中国企业自主开发的产品也很快就被仿冒,使创新者的积极性受到极大打击。这种状况的出现,同中国现行的知识产权保护法律法规的不健全有很大关系。其中,在商标保护领域里,《商标法》中的缺陷也为规范中国商标领域的实际操作埋下了隐患。

Although overseas enterprises have taken a fancy to China’s huge market potential, they have also been hesitant to hold their intellectual property rights in China and are not willing to put China on the market as the latest technology and new product. Even products developed independently by Chinese enterprises are quickly being counterfeit, greatly reducing the enthusiasm of innovators. The appearance of this situation has a great relationship with the current unsound laws and regulations on intellectual property protection in China. Among them, in the field of trademark protection, the flaws in the “Trademark Law” also lay hidden dangers for regulating the actual operation in the field of trademark in China.
