外交保护作为现代国际法中的一项重要制度,传统上被认为是一国固有的权利,本质上是一国对其国民的属人管辖权。随着历史的发展和时间的推移,其自身也处在不断的发展中。2006年联合国大会第五十八届会议二读通过的《外交保护条款草案案文》,综合了众多国家和国际法学者多年磋商与研究的成果。该案文及其评注中反映出众多令人欣喜的变革,同时,也在一定层面揭示了它未来的发展趋势。例如,对于外交保护是国家权利此“国家特征”的质疑,草案案文和评注为人们留下了广阔的探讨和发展空间。
Diplomatic protection, as an important system in modern international law, has traditionally been regarded as the inherent right of a country and is essentially the personal jurisdiction of a nation over its own people. With the development of history and the passage of time, itself is in constant development. The draft text of the draft articles on diplomatic protection adopted by the United Nations General Assembly at its fifty-eighth session in 2006 read together the results of years of consultation and research conducted by many national and international law scholars. The text and commentaries reflect many delightful changes and, at the same time, reveal its future trends to a certain extent.
