在由运动员、教练、裁判及观众等组成的体育世界中,秉持着异于一般社会规范的道德及体育竞技规则,赛场上运动员之间的肢体接触,乃至是暴力侵权行为都得到普遍的纵容。绝对地适用风险自负原则,往往使民事救济难以实现,难以应对当今体育商业化背景下体育暴力逐渐泛滥的现象。同时,体育暴力侵权归责方法的模糊性,又使法院在审理此类案件时难以把握。由于体育世界以及体育侵权行为的独特性,通过订立仲裁条款,以仲裁的方式解决体育暴力侵权纠纷,较之司法手段更具优越性。
In the sports world consisting of athletes, coaches, referees and spectators, there is widespread connivance of upholding moral and sports rules different from general social norms, physical contact between athletes on the court and even violent infringement. The absolute application of the principle of risk-taking and concealment often makes the realization of civil remedies difficult and it is difficult to cope with the phenomenon of the gradual proliferation of sports violence in today’s commercialized sports. At the same time, the fuzziness of the method of attributing responsibility for sports violence also makes it difficult for the courts to handle such cases. Due to the uniqueness of the sports world and sports infringement, it is more advantageous than the judicial means to settle disputes over sports violence by arbitration clause.
