由于价格歧视概念的模糊性,造成了认定差别定价的困难。本文分析了经济学与法学在差别定价问题上的分歧,指出,保护消费者与保护竞争者并非一回事,法律上限制差别定价的出发点不是保护消费者,而是在保护其他竞争性厂商。
Due to the ambiguity of the concept of price discrimination, it has caused difficulties in identifying differential pricing. This paper analyzes the differences between economics and jurisprudence in the issue of differential pricing. It points out that it is not the same thing to protect consumers and protect competitors. The starting point of legally restricting differential pricing is not to protect consumers but to protect other competitive firms.
