产品责任是指因产品存在内在缺陷造成他人人身、财产损害引起的赔偿责任。产品责任不是合同责任,也不等同于产品质量责任,而是侵权责任的一种特殊形式。随着人们物质生活水平的不断提高,商家向市场上投放的新产品日益增多,现实生活中因产品责任引发的诉讼将呈增长趋势。由于产品责任诉讼在举证责任的承担、管辖法院的确定等方面与其他诉讼有所不同,因此,了解相关的法律规定很有必要。
