[提要]中国晚清对于危害国家安全犯罪的规定繁多、处罚严酷。历代均极为重视对国家领土政权的刑法保护。中国古代危害国家安全罪的法律规制对现代国家的领土安全维护、政权民主建设以及构建国家权力与公民权益间的动态平衡等具有启示意义。 [Abstract] China’s late Qing rules and regulations of crimes against national security are numerous and the punishment is harsh. All the dynasties attach great importance to the criminal law protection of the territorial regime of the country. The ancient Chinese legal regulation of endangering national security has implications for safeguarding the territorial security of modern countries, building political democracy and building a dynamic balance between state power and citizen’s rights and interests.
