当前,公务员职务犯罪的滋生与蔓延已经对国家的有序运行、法治政府的建设及政府公信力造成了严重危害。公务员职务犯罪产生的原因与公务员的内在思想信念和法律意识、经济转轨过程中出现的收入分配问题及体制转型过程中出现的监督不到位等因素有关。要有效治理公务员职务犯罪问题,必须从以下几个方面入手:一是通过借鉴新加坡的廉政制度,通过高薪及财产申报制度来有效预防公务员职务犯罪;二是完善刑事立法,加大对公务员职务犯罪的立法遏制;三是深化行政体制改革,以市场手段配置资源,防止公务员在资源配置中出现职务犯罪的现象;四是完善公务员的考核与监督任用制度,从体制内防范公务员职务犯罪;五是加强公务员的法制与思想道德教育,使其自觉抵制犯罪诱惑。
At present, the breeding and spread of civil servants’ job-related crimes have caused serious harm to the orderly operation of the state, the construction of a government under the rule of law and the credibility of the government. The causes of civil servants ’job-related crimes have something to do with civil servants’ intrinsic ideological conviction and legal awareness, the problems of income distribution during the process of economic transition and the lack of supervision in the process of institutional transformation. To effectively manage the civil service duty crime, we must start from the following aspects: First, by drawing on Singapore’s clean government system, through high-paying and property reporting system to effectively prevent civil servants job-related crimes; the second is to improve the criminal legislation, increase the civil service job-related crimes Third, we must deepen the reform of the administrative system, allocate resources by means of market instruments and prevent civil servants from taking part-time job in the allocation of resources. Fourth, we need to improve the appraisal and supervision and appointment system for civil servants and prevent civil servants from duty crimes within the system. Fifth, Strengthen civil servants’ legal system and ideological and moral education so that they conscientiously resist the temptation of crime.
