在建筑工程施工中,工程合同管理发挥着重要的作用。本文以深圳某土方开挖、基坑支护及桩基础工程为例,针对本工程施工及结算过程中,发生涉及到工期及对合同部分条款不同理解的问题,总结产生这些问题的主要原因:1、全同文本存在众多缺陷;2、发包方管理混乱,遇到问题互相推脱,不严格履约;3、承包方合同管理职能工作缺乏足够的重视。进一步提出解决这些问题、提高工程合同管理的几点主要措施:1、把好合同签订关;2、规范合同的履行管理;3、做好合同实施管理;4、加强合同教育重视合同管理人才的培养;5、重视合同后评估等,以减少对施工企业的不利影响,并提出反思。
In the construction of construction, engineering contract management plays an important role. Taking a earthwork excavation, foundation pit support and pile foundation engineering in Shenzhen as an example, this paper summarizes the main reasons for these problems in the construction and settlement process of the project, involving construction period and different understanding of the terms of the contract. 1, there are many deficiencies in the same text; 2, outsource management chaos, encounter problems with each other, not strictly compliance; 3, the contractor contract management functions lack of sufficient attention. Further proposed to solve these problems and improve the contract management of several major measures: 1, the signing of a good contract off; 2, to regulate the performance of contract management; 3, to do a good job contract management; 4, to strengthen the contract education contract management personnel Training; 5, emphasis on post-contract evaluation, etc., in order to reduce the adverse impact on construction enterprises, and put forward reflection.
