本文討論了北魏太武帝神■四年和正平元年定《律》及當時《律》《令》體制的相關問題,認為其最為重要的成果,是在道武帝天興《律》《令》只是科條詔令集的基礎上,完成了《律》的法典化。表現為《神■律》建立了整套刑名系統,形成了冠於《律》首的《刑名篇》,出現了《盗律》之類的分篇,内容上也有向魏晉以來《律》文靠攏之勢。《正平律》則在《神■律》基礎上建立了一套不含“大辟”的新“五刑”系統,據以規範了刑名、罪名和罰則,進一步鞏固了《律》的刑法典地位。不過太武帝時期的《律》《令》體制總體上仍與漢代相類,乃是北魏《律》《令》逐漸向魏晉樣態發展過渡的重要一環。
