自上世纪九十年代后期以来,我国房地产业得到了前所未有的迅猛发展。与此同时,市场的不规范状况日益显现,各类纠纷层出不穷。房地产市场的纠纷,已成为影响社会稳定的一种隐忧。本文从真实的案例出发,又从分析购房者、开发商、房管局三方入手,论证了本案中房管局做法的正确性,并引用相关法律加以解释。在文章结尾建议通过完善相关规则,建立相应机制回避风险,以求化解乃至规避纠纷。
Since the late 1990s, China’s real estate industry has enjoyed unprecedented and rapid development. In the meantime, market irregularities have become increasingly apparent and various types of disputes have emerged one after another. Disputes in the real estate market have become a worry affecting social stability. Starting from the real case, this article starts with analyzing the buyers, developers and the Housing Authority three parties, demonstrates the correctness of the case and the relevant laws. At the end of the paper, it is suggested to establish relevant mechanisms to avoid risks through perfecting related rules in order to resolve and even circumvent disputes.
