一、基本案情与问题的提出2005年10月20日,重庆市第一中级人民法院公开开庭审理了某教师诉某小学教案著作权纠纷案件。案件的由来是这样的:在1990年至2002年间,某教师每学期均按照某小学的安排编写教案和上交教案。某教师先后交给某小学载有教案内容的教案本48册,但某小学仅归还其中的4册,44册教案(本)(即教案及其载体教案本)灭失,无法归还某教师。某教师遂于2002年5月30日向重庆市南岸区人民法院起诉该学校侵犯其对教案本的所有权,要求

Basic facts and issues raised On October 20, 2005, the First Intermediate People’s Court of Chongqing Municipality held a public trial of a teacher’s case concerning a copyright dispute in a primary school lesson plan. The origin of the case is as follows: Between 1990 and 2002, a teacher wrote a lesson plan and handed over the lesson plan according to the arrangement of a primary school every semester.
