2007年3月通过的《物权法》适应了担保物权制度的新发展,结合中国经济发展现袄,对传统担保物权理论予以修正,扩大了可用于担保的财产范围,设立了应收账款质押与动产浮动抵押制度,规范了登记行为,在担保物权实现规则方面做出调整等。凡此种种变化必将给银行信贷担保业务的发展带来崭新契机,但同时也将带来一些不利因素,我们需要运用辨证的眼光,在研究并探讨其利弊的基础上,积极做好应对准备,寻找解决问题的途径,才能切实防范法律风险,从而进一步促进金融业朝着健康良性的方向发展。物权法在动产担保融资方面的重大突破,并论述在新物权法框架下以应收账款和存货质押存在的法律问题及风险防范。法律上的保护对于推动动产担保的发展是非常重要。
