我国大气污染采用“立法定性+立法定量=犯罪”的定罪模式,以行政违法性定性,以违法严重性定量。这种定罪模式决定了行刑的紧密衔接,这一衔接还在行政法律中的附属刑法规范中有所体现。大气污染行为的行刑处罚呈现出行政处罚多样化、细致化与刑罚单一化、粗糙化的特点,主要原因在于刑法立法不完善,大多数问题可通过细致刑罚相关规定来解决。在行刑处罚的适用衔接上不存在竞合,而应当明确违法的行政处罚,犯罪的刑罚处罚。

There is no competing purpose in the application and connection of execution penalties, but administrative punishments and punishments of criminal penalties should be clearly defined.
