2012年3月14日,第十一届全国人民代表大会第五次会议通过关于修改《中华人民共和国刑事诉讼法》的决定。新刑诉法更强调“以人为本”的思想,尤体现在革新有关未成年人的刑案特别程序上。新刑诉法中,对未成年人采取了更多、更详尽、更具体的特别制度设计,尽可能对未成年人的各项权利进行全方位细致保护,坚持“教育为主、惩罚为辅”的原则,以期达到抑制未成年人犯罪,有序回归社会的目的。 On March 14, 2012, the Fifth Session of the Eleventh National People’s Congress passed the decision on amending the Criminal Procedure Law of the People’s Republic of China. The new Criminal Procedure Law places more emphasis on the “people-oriented” thinking, especially on the special procedure of criminal cases concerning minors. In the new Criminal Procedure Law, more and more detailed and specific special system designs have been adopted for minors, all the minors’ rights are protected in all aspects and meticulous as far as possible, and “education is the mainstay and penalties are Auxiliary ”principle, in order to achieve the purpose of suppressing juvenile delinquency, orderly return to society.
