缺乏有效的监督手段。近几年来,我们只强调执法,却忽视执法监督这一环。制定出来的法律、法规不是无人去执行,就是走了样、变了调,甚至国法为土法所代替。按照我国法律规定,各级人大是监督法律实施的机关。但是,在现实情况下,《档案法》的实施大部分单位则靠的是自身力量,靠行政机关去发号施令,那么各级人大既不能很好地监督执法,也没有很好地去监督执法,这种缺乏有效监督的机制,不仅丧失了法律应有的严肃性,而且导致了有法不依、有法难依的普遍现象发生。可以说,在各级各类档案管理中,绝大部分是有法可依的,但是真正按照法规行事的却很少,其中主要一个原因,就是缺少一个有效的监督机制,督促各级、各部门、各单位依法办事。
