哈贝马斯认为,在我们的社会中,存在着两种法律:作为媒介的法律和作为制度的法律。作为媒介的法律是调节经济和行政系统的,而作为制度的法律是调节生活世界的。作为制度的法律和作为媒介的法律都是实证性和合法性的统一,都是从生活世界的基础上建立起来的。理性法的传统和功能主义法律观都忽视了法律赖以产生的基础———生活世界。忽视这个基础就会导致系统对于生活世界的入侵。
Habermas believes there are two kinds of law in our society: the law as a medium and the law as a system. The law as a medium mediates economic and administrative systems, and the law as a system regulates the world of life. The law as a system and the law as a medium are both the unity of positivism and legitimacy, all based on the life world. The tradition of the rational law and the legal concept of the functionalism all neglect the foundation upon which the law depends - the living world. Ignoring this foundation will lead to the system’s invasion of the world of life.
