审判委员会是人民法院的最高审判组织,负责审理重大疑难案件以及对审判活动进行业务指导,审判委员会的决议,合议庭必须服从。伴随司法改革的逐渐深化,人民法律意识的不断提高,审判委员会的弊端也日益凸现。本文试图从审判委员会的性质、缺陷进行分析的基础上,提出改革方略,使这一具有中国特色的司法制度更趋合理完善。 The judicial committee is the supreme judicial organization of the people’s court and is responsible for handling major and difficult cases as well as conducting operational guidance on judicial activities. The judicial committee’s resolution must be obeyed by the collegial bench. With the gradual deepening of judicial reform, people’s legal awareness continues to rise, the drawbacks of the trial committee has become increasingly prominent. Based on the analysis of the nature and defects of the judicial committee, this article attempts to propose a strategy for reform so that the judicial system with Chinese characteristics will be rationalized and perfected.
