世界各国的竞争法实施机制主要有两种模式:私人实施和公共实施。长期以来,欧盟竞争法以公共实施为主,私人实施相对滞后,竞争违法行为导致的损害多数没有得到赔偿。2008年4月2日,欧盟委员会通过了《违反欧共体反托拉斯规则的损害赔偿诉讼白皮书》。白皮书提供了一系列建议措施以确保竞争违法行为的受害人所遭受的损失可以通过真正有效的机制获得充分赔偿。文章对白皮书出台的背景及其主要内容进行了介绍,并进而展开综合评价。最后认为,由于面临的技术性难题和成员国的政治压力,欧盟反托拉斯私人损害赔偿的未来具有很大的不确定性,欧委会想要实现自己的目标还有很长的路要走。
There are two main modes of implementing the competition law in different countries in the world: private implementation and public implementation. For a long time, the EU competition law has been dominated by public implementation, while its private implementation has lagged behind. Most of the damages caused by competition offenses have not been compensated. On April 2, 2008, the European Commission passed the “White Paper on Damages for Breach of Antitrust Law”. The white paper provides a set of recommended measures to ensure that victims of competing offenses receive full reparation through truly effective mechanisms. The paper introduces the background of the introduction of the White Paper and its main content, and then expand the comprehensive evaluation. In conclusion, due to the technical difficulties and the political pressure from the member states, the EU has great uncertainty about the future of antitrust private damages. The European Commission still has a long way to go to achieve its goal.
