【案例】王某于2013年7月入职L公司,双方签订3年期劳动合同,王某的职务为销售员。自2015年开始,L公司为了提高公司的业绩,宣布实施末位淘汰制度,公司将会根据员工的工作业绩和其他指标对员工每月考核一次,连续3个月考核排名靠后将被视为考核不合格,直接淘汰。2015年11月,公司根据考核结果,以王某连续3个月考核不合格,不能胜任工作为由,单方面作出对王某的辞退处理。
[Case] Wang joined L Company in July 2013 and both parties signed a 3-year labor contract. Wang's position is salesman. From the beginning of 2015, L Company announced the implementation of the last phase elimination system in order to improve the performance of the company. The Company will conduct a monthly assessment on the basis of employees' performance and other indicators. Rankings of three consecutive months of assessment will be regarded as Assessment failed, directly eliminated. In November 2015, according to the examination results, Wang failed to pass Wang's assessment three months in a row and could not handle the job unilaterally.
