法治政府建设是全面依法治国的核心内容。以评促成符合管理激励原理。我国改革开放30多年来法治建设及组织考评的演进历程,历经了多个阶段,呈现出不同特征,有效地促进了法治政府建设,但其本质上还是目标性考评。目前存在的目标导向及功能定位不明确、技术体系不完善、动力机制不健全等问题,甚至形成各自为政、重复考评、无所适从等现实困境。基于价值理性与工具理性的双重耦合,以政府绩效评价推进法治政府建设既体现法治精神及政府绩效的价值理性,又强化了考评作为组织管理的工具属性。为此,应创新评价理论,扩大公众参与,引入多元评价主体,完善技术体系,加强制度建设,培育绩效文化。同时,从目标考评到绩效评价的转变,有助于衍生一门新的学科——法治政府绩效评价学,从而进一步推进我国公共管理理论跨学科的融合与创新。
The construction of a government by law is the core of a comprehensive administration of the country according to law. To promote evaluation in line with the principle of management incentives. Over the past 30 years since the reform and opening up, the evolution of the rule of law and organizational evaluation has gone through several stages and showed different characteristics, effectively promoting the construction of a government under the rule of law, but it is still essentially a target assessment. The existing goal-oriented and functional positioning is not clear, the technical system is not perfect, the dynamic mechanism is not perfect and other issues, and even the fragmented reality, duplication of appraisal, loss of experience and other practical difficulties. Based on the dual coupling of value rationality and instrumental rationality, the government of the rule of law is promoted by government performance evaluation to build the value rationality that reflects the spirit of the rule of law and government performance, and strengthens the tool attribute of appraisal as organization management. To this end, we should innovatively evaluate the theory, expand public participation, introduce multiple evaluation entities, improve the technical system, strengthen system construction and cultivate a performance culture. At the same time, the change from the goal evaluation to the performance evaluation helps to derive a new discipline - government by law and government performance evaluation, so as to further promote interdisciplinary integration and innovation of public management theory in our country.
