当前经济和科学技术的发展水平越来越快,对于新型技术产业和高科技的产业来说,人才的需求成为了企业发展的最大的问题。而企业的经济发展也从原本的物质资本转变为了当前的人力资本。而人力资本出资的意思就是把人身上所拥有的相应的知识、技术、信息等当做资本进行出资,在企业中获取一定的股份,也就是说将人的能力转化为资本而得到股份。而实际上,人力资本的概念是从经济学转变为法学的一种概念,在法学界的观点上来看,人力资本是不能够成为出资的一种方式的,但是在全球经济的影响和我国社会主义市场经济的快速发展的情况下,人力资本在当前的企业竞争中也成为了一种比较稀少的资源。所以,以人力作为资本进行出资的形式也在被更多的应用。所以,在法学界对于人力资本出资的法律问题也开始进行了相应的重视和研究,而且得到了一定的成就。本文就主要对当前人力资本出资的法律地位和其他的相关问题进行了探讨。
