改革和完善上下级法院之间关系成为专家和学者们的热议话题。课题组认为,论述法院的人事管理,首先应廓清法院人事管理权性质,找到其运行规律。其次应了解古今中外在此方面做法,并结合我国国情确定法院人事管理权运行的理想状态。最后应根据目前法院人事管理权运行的现状,提出循序渐进的完善措施,进而不断推进法院人事管理的规范化、科学化。
The reform and improvement of the relations between higher and lower courts have become hot topics for experts and scholars. Task Force believes that the discussion of the court personnel management, first of all should be to clarify the nature of the court personnel management authority to find its operating rules. Secondly, we should understand the ancient and modern ways of doing things in this respect and determine the ideal state of running the personnel management power of the court in light of our national conditions. Finally, according to the present situation of the operation of the personnel management power of the court, a step-by-step improvement measure should be put forward so as to further promote the standardization and scientificization of personnel management in the court.
