商品房买卖中常因预售而出现房产商的欺诈,为强化对购房者的保护,有观点认为应对商品房买卖适用消法第54条的惩罚性赔偿。但商品房具有与其他消费品相比的特殊性,三倍惩罚性赔偿适用上存在问题,适用后可能存在的社会问题。为保障市民社会中的公平正义,实现民法的定纷止争功能,应寻求惩罚性赔偿之外的其他合理措施。
Commercial real estate sales often occur due to pre-sale real estate fraud, in order to strengthen the protection of home buyers, there is a view that the sale of commercial housing should apply the elimination of Article 54 punitive damages. However, the commercial housing has the peculiarities compared with other consumer products, the problems existing in the application of punitive damages of three times and the social problems that may exist after the application. In order to safeguard the fairness and justice in civil society and realize the definite and arbitrary functions of civil law, other reasonable measures besides punitive damages should be sought.
