一、案件事实及法院判决(一)案件事实:〔1〕在1975年2月27日的买卖合同中,被告将登记在P册土地登记簿0914页的地产39号中的第31块和第32块地块(Flurstück),〔2〕制成公证证书出卖给原告。原告从那时起即作为所有权人登记在土地登记簿中。被告同时在土地登记簿S册037页作为第30块地块的所有人而登记在册。该地块紧邻上述第32块地块。双方当事人的争议在于,在

Facts and Court Judgments (1) Facts of the Case: (1) In the contract of sale and purchase on February 27, 1975, the defendants registered in No. 31 of the Property No. 39 on page 0914 of the P-Register of Land Register, 32 plots (Flurstück), [2] made notary certificate sold to the plaintiff. Since then the plaintiffs have been registered as owners in the land register. The defendant is also registered as owner of the 30th parcel on S Register 037 of the Land Register. The parcel is located immediately above parcel 32. The dispute between the parties is that
