在当今社会,创意在经济价值的产生之中起到了越来越重要的作用。电视节目作为电视传媒业的主要部分,其创意自然具有较高的经济价值,理应受到法律的保护。然而现实中电视节目创意保护的现状却不尽人意,山寨节目层出不穷,电视节目创意市场缺乏活力。本文认为电视节目创意具备通过著作权法进行保护的正当性与可行性,从而使得电视节目创意的保护具有了法律上的依据。
In today’s society, creativity plays an increasingly important role in generating economic value. Television programs, as a major part of television media, naturally have high economic value and should be protected by law. However, in reality, the status quo of creative protection of TV programs is not satisfactory, cottage programs are endless, and TV program creative markets are lack of vitality. This paper argues that TV program ideas have the legitimacy and feasibility of protecting through copyright law, so that the protection of TV program ideas has the legal basis.
