近年来,一些城市内部的大型公共工程的建设活动,往往会带来城市住房用户房屋拆迁的负外部性问题。负责项目的企业与地方行政机关利益密切相关,自身利益最大化具有相对一致性。地方政府为追求自身的行政效率,凭借其公共权力的强制性,给予居民远低于市场价值的补偿,甚至要求居民强行拆迁,其结果往往导致居民与地方政府的激烈对抗,使社会总福利受到损失。本文结合科斯定理,在对房屋拆迁中的产权界定研究的基础上提出通过产权交易的市场化方法,以解决地方政府作为利益相关方过分干预降低资源配置效率的问题。
In recent years, the construction activities of large-scale public works in some cities often bring negative externalities to the demolition of urban housing users. The enterprises in charge of the project are closely related to the interests of the local administrative organs and have the maximum consistency of their own interests. In pursuit of their own administrative efficiency, local governments, by virtue of the compulsory public power, give residents far less than the market value of compensation and even require residents to forcibly demolish them. As a result, local governments often fiercely confront residents and local governments and make the total social welfare suffer loss. Based on Coase Theorem, this paper puts forward the marketization method of property rights transaction based on the research on the definition of property right in house demolition, in order to solve the problem of over-interference of local government as stakeholder to reduce the efficiency of resource allocation.
