由于现行农村宅基地使用权制度不甚完善,农村房屋转让中出现了大量脱离法律、规避法律的现象,影响了农村有关房、地产权利的行使。新颁布实施的《物权法》也没有对农村房屋转让问题作出明文规定,给农村房屋转让合同效力判断留下了很大的争论空间。本文认为,在遵循了“一户一宅”的原则和集体经济组织成员以外的人员补交了土地使用收益金后,农村房屋转让合同不因法律禁止或限制宅基地使用权而受影响,非集体经济组织成员购买的农村私有房屋应受法律保护。
Due to the imperfect system of the right to use house sites in rural areas, a large number of rural housing estates have emerged from the law and the law has been circumvented, affecting the exercise of housing and real estate rights in rural areas. The newly promulgated “Real Right Law” did not make any explicit provisions on the transfer of rural housing, leaving a lot of room for debate on the validity of rural housing transfer contracts.
