《中华人民共和国著作权法》(修改草案第一稿)(以下简称《修改草案第一稿》)第46条规定,录音制品首次出版3个月后,其他录音制作者可以依照本法第48条规定的条件,不经著作权人许可,使用其音乐作品制作录音制品。此条将原来对录音制品法定许可规定中的“著作权人明确声明不允许使用”的除外规定删掉,使我国著作权法中原来规定的“准法定许可”向严格的法定许可制度迈进。以高晓松、宋柯、汪峰等为代表的著名音乐人均对此修改发表了质疑,他们称“新法明显偏袒互联网、严重损害创作者个人权益”、“赤裸裸鼓励互联网盗版行径”。
