英国郡法院最初被当作国王用以平衡地方权势的制度装置 ,而其合议原则的确立则进一步促使原先的地方长官———郡长一职日渐式微。缺少有效的地方代理人制度 ,国王不得不依赖于一支巡游的司法大军来实现王国的治理 ,普通法的司法治理模式由此形成。陪审制度则不仅为中央司法权威的扩张提供了公信力的保障 ,而且也是后者得以稳健运行的制度平台。由此 ,普通法的大厦便被牢固地坐落在民间普遍认同的基石之上。
The British County Court was originally used as a system by which the king was to balance local power, and the establishment of his collegiality rule further contributed to the diminution of the original magistrate, the county magistrate. Lack of effective local agent system, the king had to rely on a parade of judicial forces to achieve the kingdom of governance, the common law form of judicial governance. Jury system not only provides the guarantee of credibility for the expansion of central judicial authority, but also serves as a system platform for the latter to run steadily. As a result, common law buildings are firmly placed on the cornerstone of popular acceptance.
