我国已颁布了大量有关不动产的法律法规,但现行的不动产法制尚有许多不完善之处。作者指出我国不动产法制中存在以下的一些问题。即,统一整体性的缺乏和行政法色彩的浓厚、土地使用权性质的不明确、土地使用权期满后无偿取得地上建筑物的不合理、农村土地所有权的名不副实等问题;在不动产担保中,存在着担保种类不全、抵押权顺序、抵押权实现、抵押物转让、物上代位等方面的问题;在不动产登记上,存在着缺乏统一的登记法及登记机关、登记请求权、登记效力等方面的问题。针对上述问题,作者提出了不动产法制的民法化、权利体系的协调化、术语的规范化、登记机关的统一化、集体所有土地的渐次国有化、确立农用土地使用权、土地使用权期满后取得地上建筑物应由无偿变为有偿、扩大不动产担保种类、完善不动产担保制度等建议。
