“法律监督”是中国法律中的一个专门术语和概念,而检察机关在社区矫正中的法律监督同样是西方各国从未实践过的,是“社区矫正中国化”的一大特色。社区矫正作为一个在我国方兴未艾的矫正模式,法律法规尚不健全,诸多环节缺乏经验,工作中难免产生纰漏。这种情况下,更需要有效的监督机制介入,保障矫正工作的有效进行。检察机关作为法律监督机关,具备丰富的实践经验,理应肩负起社区矫正工作的法律监督职责。 “Legal Supervision ” is a specialized term and concept in Chinese law, and the legal supervision of procuratorial organs in community correction is also a practice that has never been practiced in any country in the West and is a major feature of “Chinese-based community correction” . As a corrective model in the ascendant of our country, community correction is still not complete in laws and regulations, many aspects are lack of experience, and mistakes are inevitable in work. Under such circumstances, more effective monitoring mechanisms are needed to intervene to ensure the effective rectification work. As a supervisory organ of law, procuratorial organs have rich practical experience and should shoulder the legal supervision responsibility of community corrections.
