一、序言与世界各国相同,美国劳动法制之发展,其目的亦是为了确保基本劳动基准、确保合于安全卫生工作环境、防制就业歧视、维护劳动三权之机制、保护劳工免于就业上之诸多不利事务。唯自20世纪80年代以来,因美国保守主义盛行,美国劳动法之发展一直以不利劳工之方向发展。90年代克林顿总统在一些劳工保护法制定上有一些进步,然而2000年小布什总统代表共和党担任总统后,不管是在个别劳工法还是在集体劳工法上,都有许多不利劳工之做法。
