单一颜色商标属于非传统商标的一种类型,其将单一纯粹的颜色作为指示企业商品或服务来源的标志。近年来,单一颜色商标在国内外也愈来愈受到认可。我国商标法第三次修改草案也将单一颜色商标纳入商标法保护范畴。但由于单一颜色商标本身的一些特殊性,使得其与一般商标的授权条件不同。2012年9月,美国联邦巡回上诉法院Louboutin v.YSL案的判决肯定了时尚产业内单一颜色商标的可注册性,并再次重申单一颜色获得商标法保护的基本要件。最后,本文通过对美国单一颜色商标案件的研究来对我国单一颜色商标的注册和保护提出建议。
A single color mark is a type of non-traditional mark that uses a single, pure color as a hallmark of the source of an enterprise’s goods or services. In recent years, single-color trademarks are increasingly recognized at home and abroad. The third revision of the Trademark Law of our country also incorporates a single-color trademark into the scope of trademark protection. However, due to the particularity of the single-color trademark itself, it is different from the general trademark. In September 2012, the judgment of the U.S. Court of Appeals for the Federal Circuit Court of Appeals, Louboutin v.YSL, affirmed the registrability of a single color mark within the fashion industry and reiterated once again the basic requirement that a single color be protected by the trademark law. Finally, this article makes a suggestion on the registration and protection of the single-color trademark in China through the research on the single color trademark case in the United States.
