《最高人民法院关于审理涉及国有土地使用权合同纠纷案件适用法律问题的解释》(以下简称土地使用权转让合同司法解释)第九条规定,未取得权属证书的土地使用权转让合同,起诉前取得权属证书或者有批准权的人民政府同意转让的,应当认定合同有效。那么是否意味着在起诉前仍未取得权属证书或政府批准的土地使用权转让合同就应当认定无效?取得权属证书是否土地使用权转让合同的生效要件?就上述问题,最高法院第一巡回法庭在空后广州办与秦龙公司土地使用权转让合同纠纷案件中予以了全面详细的诠释。
