司法实践中,由于对在建过程中房地产登记制度的法律性质认识不一,加之不动产登记制度不够完备,故引发了不动产物权变动中的诸多法律问题。本文旨在通过对这一阶段的登记行为的深入分析,进一步明确其法律性质,并结合审判实践中发生的相关案例,探讨解决审判难点问题的方案,提出相关建议,以期为完善商品房预售登记制度和统一司法实践提供帮助。
Judicial practice, due to the legal nature of the real estate registration system in the process of construction under different understanding, combined with the real estate registration system is not complete enough, it triggered a real estate property changes in many legal issues.
