《劳动合同法》已经实施,新法体现了国家对处于弱势地位的劳动者的“倾斜保护”。高校工会如何依据该法,落实“以职工为本,主动依法科学维权”的新维权观,实现对高校教职工合法权益的保护。本文通过对高校工会维权职能内涵及其存在的困境分析,结合《劳动合同法》的具体规定,提出了实现高校工会维权职能的几点思考。
The Labor Contract Law has been implemented and the new law reflects the state’s “tilt protection” toward disadvantaged workers. According to the law, the trade unions in colleges and universities should implement the new concept of the right to safeguard their rights based on employee-based and take the initiative in accordance with the law, and realize the protection of the legitimate rights and interests of university staff and workers. Based on the analysis of the connotation and existing predicament of the rights protection of trade unions in colleges and universities and the specific provisions of “Labor Contract Law”, this paper puts forward some thoughts on how to realize the functions of safeguarding the rights of trade unions in colleges and universities.
