大陆与香港和澳门依托《建立更紧密经贸关系的安排》(CEPA)及其补充协议,经济往来日益密切。中国两岸四地在WTO中一国四席的现状,四地在资源、生产要素、产业结构、进出口贸易等多方面存在的差异性、互补性的前提,以及出于经济利益的诱惑和发展自身经济的迫切性都为两岸四地的经济整合提供了现实基础。在全球化大背景的驱动下,追求各个合作区域的经济利益最大化是其整合的本质要求。在合作区域内,伴随着大规模的生产要素流动,交易成本的降低等都是提高区域综合竞争力的有利途径。在这种背景下,如何为两岸四地的经济整合提供法律支撑,使其整合具有法律保障成为当下的重要问题。本文主要从法律角度探讨两岸四地区域经济整合的必要性、依据,以及对两岸四地区域经济的整合的法律建议。
The Mainland has increasingly closer economic ties with Hong Kong and Macao on the basis of the CEPA and its supplementary agreements. The status quo of the four places across the Taiwan Strait in the WTO and the differences and complementarities between the four places in terms of resources, factors of production, industrial structure, import and export trade, and the temptation and development for economic interests The urgency of their own economy provides the realistic basis for the economic integration of the four places across the Taiwan Strait. Driven by the background of globalization, the pursuit of the maximization of economic interests in all cooperative regions is the essential requirement of its integration. In the cooperation area, along with the flow of large-scale production factors and the reduction of transaction costs, all are favorable ways to enhance the comprehensive competitiveness of the region. Under this background, how to provide legal support for the economic integration of the four places across the Taiwan Strait and ensure its integration with legal guarantees has become an important issue nowadays. This article mainly probes into the necessity and basis of regional economic integration across the Strait and legal suggestions on the integration of the regional economy across the Strait.
