21世纪是设计经济的时代,著作人将创意、知识、价值导入设计企划,进而以文化诠释商品的附加价值,成为台湾经济及形象发展之战略,也是台湾企业进军国际市场提升竞争力之核心元素,使得民众对艺术的品位与对各种文化,有更进一步之认识与赏析。本文以知识产权作为论述核心,包括台湾的“专利法”、“商标法”及“著作权法”等法规,分析创意文化产业如何应用这些知识产权法规。本文首先介绍台湾“文化创意产业发展法”的“立法”目的、体系架构及保护范围。其次阐述如何以“专利法”、“商标法”及“著作权法”保障文化创意产业之成果。此即结合法律与文化创意特性,寻求对产品保护范围的最大化,应用法律捍卫设计师辛勤创作后的结晶,企求文化产业之成果,得以搭配企业设计策略,经营出自身的品牌,促进台湾设计产业的竞争力。
The 21st century is an era of economic design. As writers introduce creative ideas, knowledge and values into design and planning, cultural interpretation of the added value of commodities has become a strategy of Taiwan’s economic and image development. It is also a key element for Taiwanese enterprises to enter the international market and enhance their competitiveness , So that people on the art of the grade and of various cultures, have a better understanding and appreciation. This article takes intellectual property as the core of the discourse, including Taiwan “Patent Law ”, “Trademark Law ” and “Copyright Law ” and other regulations to analyze how creative industries apply these intellectual property laws and regulations. This article first introduces the purpose, architecture and scope of protection of Taiwan’s “Law on the Development of Cultural and Creative Industries”. Second, it expounds how to protect the achievements of cultural and creative industries with “Patent Law”, “Trademark Law” and “Copyright Law”. This is the combination of legal and cultural creative features, seeking to maximize the scope of product protection, the application of law to defend the designers after the hard work of the crystallization of the demand for cultural industry results, with business design strategies to run their own brand, and promote Taiwan’s design Industrial competitiveness.
