世界各国普遍采用法律手段约束非物质文化遗产的保护行为,促进非物质文化遗产的可持续发展和使用。本文通过分析非物质文化遗产保护的法律基础,就加强非物质文化遗产法律保护提出了相应的建议。非物质文化遗产是存在于世的,并且为人们所传承的文化遗产。按照2011年6月起实施的《中华人民共和国非物质文化遗产法》(下称《非遗法》)的定义,非物质文化遗产“是指各族人民世代相传并视为其文化遗产组成部分的各种传统文化表现形式,以及与传统文化表现形式相关的实物和场所。”
All countries in the world generally use legal means to restrain the protection of intangible cultural heritage and promote the sustainable development and use of intangible cultural heritage. By analyzing the legal basis for the protection of intangible cultural heritage, this article puts forward corresponding suggestions to strengthen the legal protection of intangible cultural heritage. Intangible cultural heritage is present in the world, and for people to inherit the cultural heritage. According to the definition of intangible cultural heritage law of the People’s Republic of China (hereinafter referred to as “non-heritage law”) implemented since June 2011, intangible cultural heritage “refers to people of all nationalities who are handed down from generation to generation and are regarded as their cultural heritage Part of the various traditional cultural expressions, and related to the traditional cultural expressions and objects and places. ”
