世界上对于最低工资立法有专门立法模式和非专门立法模式。对此问题,在国家法律层面,我国采用的是非专门立法模式;在部门规章和地方立法层面,我国采专门立法模式。我国人口众多,经济发展极不平衡,最低工资立法还处于摸索阶段。因此,我国在法律层面采非专门立法模式、在地方采专门立法模式有其局限性。为了制定科学合理的最低工资制度,对于最低工资标准的确定中的地域性标准和数额的确定、是跨行业立法还是分业立法、是制定《最低工资法》还是制定《工资法》、建立最低工资标准确定及增长机制、最低工资制度主要涉及对象等问题应当予以厘清。
