在中小学教材著作权保护中,教材是否为著作权法意义上的作品?教材的著作权究竟应该由谁享有?教材在编写出版过程中(特别是语文、美术、音乐等)要选用大量已发表作品,应该对所选作品著作权人所享有的著作权进行怎样的限制?这都需要我们在法律上加以明确的问题。我国《著作权法》应从给中小学教材以明确定位、放宽教材编写与出版的著作权限制以及加大对盗版等侵犯教材著作权的打击力度这三个方面来加强我国《著作权法》对中小学教材著作权的保护。
