随着计算机互联网技术的发展,网络广告迅速崛起。但是,元标签、链接、放置甜饼和垃圾邮件等网络技术被众多商家滥用,虚假广告充斥网络。而我国目前的法律与网络广告的发展不相适应,严重制约了它的健康发展。因此,本文分析了违反竞争法的网络广告,考量了相关法律适用现状,并提出了网络广告法律规制的建议:在制定完善的法律规制网络广告的同时,将政府管理与行业自律结合起来,以弥补法律的缺陷,且由于网络广告的无国界性,因此需要加强网络广告管理的国际合作。
With the development of computer Internet technology, online advertising has rapidly risen. However, meta-tags, links, web cookies such as cookies and spam are abused by many businesses and fake advertisements are flooding the internet. However, the current laws of our country are not compatible with the development of online advertising, seriously restricting its healthy development. Therefore, this article analyzes the online advertising that violates the competition law, considers the status quo of the application of the relevant laws, and proposes the legal regulation of online advertising: To make up for the legal shortcomings, and because of the borderless nature of online advertising, there is a need to strengthen international cooperation in online advertising management.
