量刑规范化是各国审判机关面对的世界性司法难题。在我国,由于长期受“重定罪、轻量刑”及“重刑主义”传统思想影响,量刑公正问题直至近年来才得到各级审判机关的关注。量刑不规范表现在同一时期相同或相似案件量刑差异较大,还表现在不同时期相同或相似案件量刑差异较大。这既有立法方面的原因,也有司法和其他方面的原因。针对法定刑幅度过大、量刑情节的概括性导致法官自由裁量权过大从而使量刑不规范的问题,量刑规范化的主旨是主张从立法上细化法定刑幅度和量刑情节的调节幅度。我国的量刑规范化改革势在必行,问题的关键在于找准改革途径。美国的《联邦量刑指南》、日本对量刑基准的立法探索以及各国量刑程序的制度设置给我们的启示是:必须树立以责任为基础、以预防为目的的量刑指导思想,必须确定统一的法官量刑基准,量化量刑情节,统一制定量刑比例。
The standardization of sentencing is a worldwide judicial challenge confronting judicial organs in various countries. In our country, due to the long-term influence of the traditional concepts of “conviction, light punishment” and “serious punishment”, the issue of sentencing justice has not been paid attention to by judicial organs at all levels until recent years. Non-standard sentencing performance in the same period the same or similar cases sentencing difference is larger, but also in different periods of the same or similar cases sentencing difference. This is both a legislative and judicial as well as other reasons. Aiming at the oversize of the statutory punishment and the generalization of the sentencing circumstances, the discretion of the judges is too large to make the sentencing irregular. The purpose of the standardization of sentencing is to advocate the legislative adjustment of the range of the statutory penalty and the circumstances of the sentencing. The standardization of sentencing reform in our country is imperative. The crux of the problem lies in finding out the ways of reform. The enlightenment of the “Federal Sentencing Guide” to the United States, the legislative exploration of the sentencing benchmark in Japan, and the institutional arrangements for the measurement of sentencing procedures in other countries is that we must establish a guiding principle for sentencing based on responsibility and for prevention and must determine the uniform sentencing of judges Baseline, quantify the circumstances of the sentencing, uniform sentencing ratio.
